Mixed waste

Until 1976, when the Resource Conservation and Recovery Act (RCRA) was enacted, there was a consensus that radioactive waste needed to follow the regulations of the Atomic Energy Act (AEA). The passage of RCRA and subsequent court decisions have made it clear that mixed waste must follow the regulations of RCRA as well as those of AEA. This paper examines the regulatory issues associated with the compliance with the two laws. In particular, it discusses the contradiction between the performance requirements of AEA and the design requirements of RCRA. The inspection requirements of the waste package are discussed. The impact of the 1984 amendments of RCRA on the management of mixed waste is discussed with particular emphasis on land disposal restriction mandated by the amendments. The paper identifies the compliance requirements that make essentially no protective contribution and yet add to the cost of waste management.
