EDF: New York oversight plan a disaster for SO[sub 2] trades

New York state officials have asked a federal court to review the Environmental Protection Agency's sulfur dioxide emission allowance trading program, charging that it could allow Midwest utilities to discharge excessive acid rain pollution. In filing a lawsuit against EPA in the US Court of Appeals for the District of Columbia Friday, the state claimed the agency failed to establish a proper [open quotes]oversight mechanism[close quotes] for allowance trades. Specifically, state officials said EPA should review allowance trades to ensure that Midwest utilities do not buy large amounts of emission credits and, thus, avoid the large-scale reductions in SO[sub 2] pollution otherwise required by Congress in the 1990 Clean Air Act Amendments. However, that contention was rejected by officials at the Environmental Defense Fund, an environmental group that helped craft the allowance trading program. Those officials said a regulatory oversight mechanism would be disastrous for the allowance trading program because it would discourage utilities from participating.
