How well are PURPA's cogeneration incentives functioning

The history of the Public Utility Regulatory Policies Act (PURPA) legislation to date shows how difficult entrenched legal barriers to a technology are to remove. The authors show how the multiplicity of approaches pursued by different state public service commissions in fulfilling the Federal Energy Regulatory Commission's rules reveal the indefinite nature of the PURPA mandate at the state level and the continued uncertainty investors may face in attempting to evaluate the attractiveness of a cogeneration project. Cogeneration appears to be making gains where state commissions have chosen to take the substantive mandate to encourage cogeneration seriously, rather than merely to implement PURPA procedures. 2 references, 2 tables.
