Discussion of the hazardous spill control regulations

A discussion of the Hazardous Spill Control Regulations of the Federal Water Pollution Control Act of 1972 showed that the regulations on the spill discharge of oil are presently operational and control oil spill via cleanup liability, spill prevention requirements and emergency response obligation. Owners or operators of vessels or facilities which discharge hazardous materials are subject to civil penalties and liability costs. The EPA has proposed hazardous materials regulations which cover: the designation of hazardous materials, determination of removability, defining harmful quantities, and establishment of penalty rates. Two significant policy issues remain unresolved: mitigation of nonremovable substances and discriminating between use of high and low penalty schedules. The EPA is considering replacing the present ''gross negligence concept'' as the discriminator between high and low penalty assessments with a new ''gravity of the violation concept''. This would provide for more equitable treatment of discharges of hazardous materials by allowing the EPA to use the total range of penalties, e.g., both the high and low options.
