EPA`s new RCRA organic waste standard: Subpart CC

EPA is continuing its efforts in cross-media pollution control, the latest phase being RCRA Subpart CC, a hazardous waste regulation designed to control air emissions. It was the original intent to include only permitted TSDFs and interim status facilities in these new air standards. Through the public participation process, however, the applicability of the Subpart CC standards has been expanded to also include hazardous waste generators. Subpart CC certainly has a large impact on US industry. It impacts TSDFs and large quantity generators (LQGs) that handle hazardous wastes with an average volatile organic content (AVOC) greater than 500 ppmw. To determine which waste streams are regulated, affected facilities must perform an AVOC determination for each waste, using either direct measurement testing or knowledge of the waste. Once all affected organic waste streams have been inventoried, Subpart CC establishes air emission controls dependent on the storage practice employed. Tanks used to manage affected organic wastes must comply with one of two air emission control options. Affected surface impoundments must be equipped with a floating membrane cover or a cover vented through a control device. Finally, Subpart CC establishes three levels of air emission control for affected containers, the control level dependent on the container design capacity and use. In addition to discussing in detail each control level, testing, inspection, and recordkeeping requirements for affected tanks, surface impoundments, and containers, this paper will also discuss Subpart CC`s affect on other potential on-site waste activities, such as wastewater treatment systems, aerosol can puncturers, drum funnels, and ground water treatment systems.
