Mixing water and the commerce clause: the problems of practice, precedent, and policy in Sporhase v. Nebraska

The Supreme Court considered whether to apply the dormant commerce clause in Sporhase v. Nebraksa, a case involving state restriction of water exports. This paper analyzes the case in terms of its relevance to water law, its doctrinal departure from prior cases involving natural resource embargoes, and its policy implications in permitting the enactment of undesirable embargoes of other resources. The case is essentially one of state's rights, but the author concludes that it oversteps sound policy in granting such broad embargo rights to the states because it favors in-state consumption over evenhanded regulation. 157 references.
