New source standard for power plants ii: consider the law

The legal framework for the formulation and enforcement of air quality standards is discussed. DOE, which had originally supported the notion that environmental protection should take precedence over energy considerations, has reneged on its original policy and now opposes the setting of strict emission control standards for coal-fired power plants. The sliding scale percentage reduction for sulfur dioxide that has been proposed by DOE and the utility industry is illegal. An alternative SO2 standard for new power plants that meets legislative mandates is proposed. (97 references)
