A review of the Wyoming's rejection of the Oklahoma Rule in a case involving the Superior Oil Company's lease holdings and a suit claiming that too much time had gone by since the last drilling took place. The case note traces the development of the burden of proof rules in cases concerning an implied covenant to develop, and examines the merits of these rules and the reasons for the Wyoming Court's action in rejecting the argument in Superior's case. It finds the Wyoming rule to be too rigid in failing to adequately recognize the lessor's rights to receive royalties. Although the court was correct in rejecting the Oklahoma rule, it should have adopted a less stringent alternative to the Texas rule.
