Ute Tribe ruling could impact Utah budget

Now that the Ute Tribe has been awarded jurisdiction over most of Duchesne County, over half of Uintah County and Parts of Wasatch County, the Utah treasury fears that it might lose up to $40 million a year in mineral royalties. The ruling gives the Utes jurisdiction over 2.9 million acres in addition to the existing one million acres of trust lands. About half of Utah's mineral revenues come from the oil and gas resource in the Uintah Basin. Among the funds which could be in jeopardy are a mining occupation tax, 4% at the wellhead; a two mill tax on oil and gas production; 12.5% royalties from production on state land and federal mineral revenues. The lawsuit does not stipulate whether the Utes can imposed a severance tax.
