Residential conservation service programs: is utility financing mandatory

A review of several court and Public Service Commission (PSC) decisions of the past three years examines the issue of mandatory utility financing of residential conservation programs. The National Energy Conservation Policy Act does not speak to the issue. The District of Columbia PSC differed with the hearing agent's perception of how far regulatory authority extends when utilities engage in nonutility business. Related cases in several jurisdictions decided that permissive authority is not enough in California, that the Iowa agency lacked expertise in energy-conservation finding, and questioned issues of customer discrimination and cost-effectiveness.
