Vermont's challenge to exclusive Federal jurisdiction over hydroelectric projects

Two cases will be argued in Vermont federal district courts on the right of states to review license applications independently of the Federal Energy Regulatory Commission. At issue is whether local expertise on environmental impacts is part of the new federalism or whether it is more important to have uniform federal regulations. Opposing decisions were reached by the town of Springfield and the Vermont Public Service Board in the two cases. The court can reassert federal preemption of state authority, or it can impose conditions on hydroelectric and reclamation projects as long as they do not contravene federal regulations. A review of pertinent cases indicates the precedent for making exceptions and expanding state jurisdictions. (DCK)
