Energy conservation - a new factor in certain utility rate regulation

Federal Energy Regulatory Commission (FERC) rules under the Public Utility Regulatory Policies Act (PURPA) held that utilities must pay the full avoided cost for the electricity they buy from non-traditional suppliers. The Supreme Court upheld the full avoided-cost rule because it met PURPA's goal of providing incentives to use alternative energy sources to generate power and because consumers will benefit in the long run from energy conservation even when electric power is not in short supply. This approach will likely be applied to other PURPA-related rate cases. 51 references.
