Availability and use of discovery at the Federal Energy Regulatory Commission: the need for modernization

An increasing work load, outdated discovery regulations, and a cumbersome discovery mechanism make it necessary to modernize the Federal Energy Regulatory Commission's (FERC's) discovery process to make it more effective. After a promising start in 1947, the FERC's discovery procedures have lacked the periodic revision needed to keep pace with the commission's ever-changing regulatory responsibilities. The authors recommend a general discovery provision to replace piecemeal regulations that restate the same principles. They also recommend a rule to deal with the failure to comply with a discovery request or a subpoena, several changes to bring the commission's deposition provisions into conformity with other discovery principles and mechanisms, and a codification of discovery rules. 242 references.
