Enforcement at the Federal Energy Regulatory Commision: considerations for the practitioner

An overview of the more important aspects of the Federal Energy Regulatory Commission's (FERC) five-year separate enforcement program emphasizes observations and considerations which may be helpful to the practitioner. Beginning with the legal bases for and the due process requirements of FERC investigations, the article then describes the kinds of investigations conducted by the Enforcement Division and a number of matters which may arise during the course of investigations. This includes subpoena enforcement, assertion of the attorney-client privilege, and assertion of reliance upon the advice of counsel. There follows a discussion of the manner in which settlement negotiations are conducted and significant aspects of several settlements recently approved by the Commission. In adopting the approach of self-implementing regulations, the Commission must increasingly insist on the integrity of its processes if regulated entities are to police themselves. 156 references.
