Part 3 of the hearing record covers two days of testimony by Anne Burford, former EPA Administrator, and four members of the EPA staff and counsel. Under investigation was the agency's failure to deliver Superfund files to the Office of Management and Budget on the grounds of executive privilege. Witnesses described situations where those under regulation appeared to be having a role in setting the regulation standards. Ms. Burford was asked to review EPA procedures in this context and to explain the rationale for assuming executive privilege on matters pertaining to hazardous waste control.
