Federal regulation of the pipeline industry: a summary review
Technical Report
·
OSTI ID:6513241
The primary objectives of the project are to assess the susceptibility of the pipeline industry to technological innovations and to identify the associated research, development, and demonstration (R, D, and D) requirements. This report presents the results of Task 2.2, which has two primary objectives: (1) the identification of the jurisdictional areas of the Federal regulatory agencies, and (2) an examination of the amenability of the regulatory system to the introduction of energy-conservative new technology into the pipeline industry. The nature and subtleties of some inhibitory influences of regulation upon energy-conservative innovations are discussed in Section 7.2. However, scenarios for specific innovations cannot be treated until more work in Task 3, Efficiency Improvements, has been done. When some specific improvements have been identified and studied, the influence of regulation upon them will be examined. The results will be presented in the final report, SSS-77-R-3020, or possibly in a revision to this report. This report is primarily devoted to reviews of the regulatory agencies who exercise influence upon pipeline construction and operation. However, there are two additional areas of government influence which are not specific to pipelines but apply to all industries - the income tax laws and the antitrust laws. It is seen in Section 7.2 that the former are very important to the objectives of this study. It may also well be that the latter are also important, i.e., that introduction of certain innovations might place the pipeline operator in a position which the Department of Justice would regard with suspicion. As specific innovations and scenarios are explored in Task 3, this possibility must be reviewed in each case, and the results presented in the final report or in a revision to this report.
