Aspects of coal transportation deregulation

It is argued that the statutory schemes under the Staggers Rail Act of 1980 regarding deregulation of railroads limits the extent of the Interstate Commerce Commission (ICC) regulation of most rail rates. Captive traffic, such as most coal traffic, is still subject to some regulation. However, the method for securing ICC review of a rate is extremely complex. Enormous sums of money are at stake and coal shippers should understand the various proceedings being conducted by the ICC and on review in the courts to protect their interests.
