Oil-pipeline regulation after Williams: does the end justify the means

The Federal Energy Regulatory Commission's (FERC's) decision in William Pipe Line Company is statement of regulatory policy, not just a rate case. More than just the established of the framework for regulating oil pipelines, it expresses FERC's basic regulatory theories and concepts and the exercise of the Commission's power to define and decide issues in terms of ''policy, political science, and prudence.'' The result is not fully satisfactory to either critics of the Interstate Commerce Commission or FERC, but it focuses attention on whether the approach taken will be difficult to implement. If FERC clarifies and exercises its new rules quickly, attention may shift to Congress to decide on the criteria for regulating oil pipelines. If this happens, others may seek legislative solutions to FERC's efforts to set regulatory policy. 86 references.
