Encouraging the installation of pollution control equipment: the use of automatic adjustment clauses

A major policy question in the environmental arena focuses on how polluters can be compelled or convinced to install what government agencies consider to be appropriate control technologies. The usual approach to this problem lies in traditional forms of regulation - a government agency sets standards or requirements that polluters must meet. When this approach is unsatisfactory or not sufficiently productive, however, alternatives to regulation must be considered. Environmental adjustment clauses represent one such alternative. These clauses are similar to fuel adjustment clauses in that they allow electric utilities to pass through to customers the increased costs due to the installation of environmental controls without the need for rate hearings by regulatory agencies. A preliminary analysis of environmental adjustment clauses in the fifty states and the District of Columbia is presented.
