Coal transportation and deregulation: an impact analysis of the Staggers Act

This analysis of the impact of the Staggers Act on coal transportation is described as a mid-stream study because many of the issues covered in the book have yet to be resolved. Noting that the Staggers Act is not specifically designed to deregulate coal traffic, the author says the coal industry, and electric utilities, as one of coal's largest consumers, feel the impact of the legislation more than the other sectors. When the Staggers Act became law, concern centered on improving the railroad industry's profits, just at the time coal was becoming the industry's fastest-growing revenue source, says the author. He looks at how the Staggers Act has created both problems and opportunities for coal-consuming, -producing and -transporting industries. The first section reviews the Act's legislative history, showing why coal traffic is an important part of the law. The second section, covering railroad rates, describes how rates for coal traffic are set, increased and protested and how rate disputes are resolved. The third section discusses railroad cost determination and the fourth section covers competitive effects the Act was designed to foster. The final chapter is a series of brief overviews of potential amendments to the Act and issues that could have an impact on the rail industry. Among the issues is the coal industry's push for legislation that would grant federal eminent domain to coal-slurry pipelines.
