FERC policy on escalator clauses under the Natural Gas Policy Act

The Natural Gas Policy Act of 1978 limited the Federal Energy Regulatory Commission's jurisdiction by mandating ceiling prices and eliminating jurisdiction over certain categories of gas. The act does not by its terms, however, supersede or nullify the effectiveness of any price established by existing contract. By interpreting and shaping the use of price-escalator clauses in existing contracts, therefore, the FERC may still exercise an historic kind of jurisdiction over the prices of flowing gas. The commission has taken several recent policy actions to limit the use of escalator clauses for obtaining higher ceiling prices for flowing gas pursuant to the Natural Gas Policy Act. This article summarizes the circumstances and legal implications of the commission's actions.
