FERC policy on price escalator clauses under the natural gas policy act: an update

Information given in an article published in the March 15 issue of Public Utilities Fortnightly is supplemented, following the release of Order No. 23, in which the Federal Energy Regulatory Commission (FERC) made substantial changes in its positions on price escalator clauses under the Natural Gas Policy Act. The new order confirms the contractual authority of area rate and Federal Power Commission clauses of existing interstate and intrastate contracts, providing a clear basis for producers to charge and collect higher natural gas ceiling prices. Challenges are expected from consumer groups.
