International power projects: Making the business opportunities achievable

United States companies are emphasizing the international power market as a key source of future earnings growth, and pressure to meet the increasing demands of the developing world is great. However, much existing capacity is reaching the end of its useful life or has inadequate maintenance or operation. This article discusses changes in regulatory and other factors which would help US companies overcome the obstacles to participation in the overseas electric power market. Topics covered in more detail include the following: privatization and what type of framework would work best; other recommended regulatory reforms: real commitment and support of host government; key foreign legal and business issues such as change of laws, currency, legal system, political, foreign regulation of sales, business format and regulation, and intellectual property; extraterritorial application of US laws including utility regulation, trade regulation; and tax implications.
