Report of the Committee on Practice and Procedure
The major development in the Federal Energy Regulatory Commission (FERC) administrative practice during 1984 was the Commission's issuance of its proposed discovery rules on July 26, 1984, in which the Commission announced its intentions to codify new rules for discovery in trial-type proceedings which track the Federal Rules of Civil Procedures for many provisions. The discovery rules would affect FERC staff, the deposition of non witnesses, site access, sanctions, and protective orders. The report covers hearing requirements and procedures, settlements, judicial review, rehearing, and other developments involving major opinions by the US Court of Appeals for the District of Columbia Circuit and Commission orders and opinions and judicial opinions relating to the necessity for on-the-record hearing in contested proceedings.
