Impact of utility bankruptcy on the parallel operating agreement

The threat of utility bankruptcy makes it difficult for cogeneration and small power projects in several states to obtain financial backing for cogeneration projects. Cogenerators can obtain a legal opinion stating that if the purchasing utility files for reorganization under the Bankruptcy Code, the buyback contract can be altered only with the prior approval of both the Bankruptcy Court and the state Public Service Commission. Such legal opinions have succeeded in allowing cogeneration and small power projects to proceed by demonstrating that the risks of a liquidation bankruptcy are small.
