Public-utility bankruptcy: lessons for management and creditors

Cash-flow crises and balance sheet insolvency resulting from inadequate rate relief and the interruption or cancellation of major construction projects have brought several utilities perilously close to bankruptcy proceedings. Given the uniquely regulated revenue structure of utilities and their obligation to provide essential service to the public, what guidelines would govern a utility company's operations during bankruptcy and its plan for reorganization. This article reviews the significant effects of public utility bankruptcy from the creditors' perspective and suggests several management strategies aimed at easing the pressures which may lead to more serious financial crises.
