Title: New source review reform air quality related values Class I area impact evaluation

Nearly 20 years after the inception of the new source review (NS R) program, the Environmental Protection Agency (EPA) proposes some significant changes to the program The proposed changes, among other things, affect the applicability of new sources, operational flexibility strategies, and the pre-construction review procedures, Changes to the pre-construction review procedures include a definition of the impact determination for air quality related values (AQRVs). This paper concentrates on this impact determination and the role of the Federal Land Manager (FLM) in the Prevention of Significant Deterioration (PSD) permitting process. The proposed regulation changes the definition of the role of the FLM and changes the interaction required to complete the review process. The Proposal from EPA will modify both 40 CFR 51.166 and 40 CFR 52.21. EPA is proposing the comparison of actual past emissions to the expected future-actual emissions after the change as part of the applicability determination of an emission increase. This policy was a adopted for the Electric Utility industry as a result of the Wisconsin Electric Power Company (WEPCO) decision. Basically this policy allows an exemption from NSR for specific changes that would result in a reduction to actual emissions. The proposed regulations also formalize the {open_quotes}top down Best available control technology (BACT){close_quotes} policy adopted by EPA. The Federal NSR program includes New Source Performance Standards (NSPS), Non-attainment area provisions, and the PSD regulations. PSD has required a proposed major new source or major modification to identify the potential impact to the soils, vegetation and visibility, (40 CFR 52.2 1 (p)(3)). Under the Federal Land Management Policy Act of 1976, the Federal Land Manager (FLM) is assigned the responsibility to preserve and protect the lands, under the management, for future generations. This requirement exists for all Federal Lands, not just Class I areas.
