Legislative history supports the Federal Energy Regulatory Commission (FERC) ruling that PRI Energy Systems, Inc. is qualified as a cogenerating facility under the Public Utility Regulatory Policies Act. The Hawaiian Electric Company, Inc. petitioned for denial of certification on the grounds that PRI would be making direct sales to end users rather than for resale. The Commission responded that Congress did not establish criteria for the type of purchaser, and that the decision to certify should be resolved at the state level.
