FERC issues declaratory order on wheeling questions
The Federal Energy Regulatory Commission (FERC) issued a declaratory order in a proceeding initiated by the Florida Power and Light Company and the Florida Public Service Commission with four specific rulings: (1) FERC wheeling rate authority is preemptive if transmission is in interstate commerce. (2) FERC will give weight, but not necessarily defer, to a state's rate determinations in special cases involving cogeneration and small power facilities. (3) There was no ruling on whether the Florida Commission wheeling rates were unduly discriminatory or inconsistent with public policy or whether states have the authority to require wheeling. The result is to place the burden on those favoring preferential rates. The existing wheeling authority in the Federal Power Act are limited, but this ruling leaves the issue of state authority to require wheeling open.
