Relicensing process: will joint ventures work

Money could be the determining factor for establishing joint ventures between existing licensees and third parties during the relicensing process. This could also serve the interests of the Electric Consumer Protection Act (ECPA) by optimizing hydroelectric resource development, although it could have a negative effect by allowing certain parties to gain unfair advantages over other competitors. The author describes how the Federal Energy Regulatory Commission (FERC) might view these cooperative efforts and how developers can structure the efforts to satisfy the FERC's concerns. Citing case histories and rulings that deal with these concerns, he notes several options which permit enough flexibility for a third party to operate at the relicensing stage.
