Farmers Union II: Sisyphus starts up the hill again

The D.C. Circuit Court of Appeals had three bases for reversing the Federal Energy Regulatory Commission (FERC) oil pipeline ratemaking methodology in Farmers Union Central Exchange v. FERC. The Court stated that FERC failed to satisfy its statutory mandate that oil pipeline rates be just and reasonable, that FERC's decision was neither the product of reasoned thought nor based upon a consideration of the relevant factors, and that the combination of the rate base of return methodologies did not produce an acceptable end result as required by prior Supreme Court decisions. This article discusses the Court's opinion in detail, developing the Court's reasoning for each of its bases for rejecting the FERC's decision and exploring some of the decision's implications. 103 references.
