Maryland People's Counsel: will it spur changes in FERC's regulation of the natural gas industry

Following a description of the market forces motivating the current changes in natural gas marketing and regulation, the authors discuss the Court of Appeal's holdings in Maryland People's Counsel (MPC) I and II. The court found in MPC I that FERC was not justified in excluding certain customers from special marketing programs, and in MPC II it vacated, in part, blanket certification orders designed to streamline the regulatory process. Although FERC's intent was good, basically successful programs did not survive appeal because the Commission failed to adhere to the principles of administrative law.
