Court nullifies gas carriage, sales schemes: effect debated

A federal appeals court nullified natural gas carriage and discount sales programs authorized by the Federal Energy Regulatory Commission (FERC) to encourage price cuts unless they are nondiscriminatory to all users. A suit by the Maryland People's Counsel claimed that the programs unfairly aid dual fuel users. Legal interpretation and follow-up will determine the impact of the decision. FERC appears to have the options of eliminating the end-user transportation programs, limiting the programs to users who cannot switch fuels, or forcing those pipelines with transportation programs to serve everyone. Parties to the cases have several weeks before the court issues mandates to formalize the decisions.
