Shared savings troubles user; vendor blames contractor

Tomy Corp., a California toy manufacturer, is happy with the 36% savings from an energy-management system, but not with the shared-savings firm because of equipment difficulties from malfunctions and side effects and with the firm's poor response to problems. The Leviton Manufacturing Co., Inc. warned the shared-savings firm that it was planning an improper application of the equipment by using a voltage-reducing lighting control that weakens the powerline signal. Tomy's mistake was in designating the firm instead of Leviton as the contractor. (DCK)
