Reform of the rate-setting process at the Federal Energy Regulatory Commission

The FERC chairman points out inherited and inherent weaknesses in federal attempts to regulate and resolve electric-utility rate cases. Attempts to reform the rate-setting process have focused criticism on the chairman, lawyers, and bureaucrats, but the author identifies inflation as the real villain. Findings under the Public Utility regulatory Policies Act (PURPA) indicate the need for generic rule-making proceedings that will be decisive enough to satisfy the courts. There are barriers to this approach, however, and a cooperative effort between industry, utilities, and customers is suggested as the best approach to meaningful reform. (DCK)
