Congress' attempt to resolve the conflict between persons affected by Federal coal under their land and the public's right to mine that coal may have created new problems by passing the Surface Mining Control and Reclamation Act of 1977. This article reviews the background and legislative history of the Act and the problems that developed from its implementation in the areas of consent validity and revocability and in the definitions and qualifications of surface ownership.
