Surface Mining Control and Reclamation Act of 1977: regulatory controversies and constitutional challenges

The Surface Mining Control and Reclamation Act of 1977 sought to balance the need to develop coal resources with environmental protection and agricultural productivity while maintaining the primacy of state regulation. The controversy and litigation which underscore hardship issues stemming from the tenth amendment and the takings clause of the fifth amendment have prompted Congress to consider new legislation. Regulatory stability is essential, however, before the coal-mining industry can increase productivity. 108 references. (DCK)
