Surface mining reclamation in Appalachia: impact of the 1977 Surface Mining Control and Reclamation Act

New coal mining and mined land reclamation techniques that reduce adverse environmental impacts, although at increased production costs, are reviewed. These techniques include various overburden storage methods, segregation of overburden and removal of toxic substances, and topsoiling. The Surface Mining Control and Reclamation Act finally passed in 1977 after long battles in Congress. Mining companies have challenged the constitutionality of the act, which requires surface-mined land to be restored to a condition that can support the original use or an approved higher or better use. Primary responsibility for enforcing regulations rests with the states. Operators of small surface mines are being forced out of business by the high costs of meeting new environmental standards.
