Department of Energy crude oil producer price regulations: an overview and an update

Selected regulatory provisions and recent court decisions concerning crude-oil-producer price regulations are discussed, following a review of the history of wage and price controls. Current regulations under Subpart D of the Mandatory Petroleum Price Regulations involve property issues, stripper-well release exemptions, base production control levels (BPLC), and price determinations. New developments will phase out price controls by September 30, 1981, but price controls on newly discovered crude oil, upper-tier ceiling prices on crude oil from marginal properties, elimination of cumulative deficiencies, and BPLC decisions took effect on June 1, 1979. The provisions to exempt tertiary recovery projects from price controls as price incentives for enhanced recovery are described. Recent court cases have concerned the definitions of property and posted price, the constitutionality of the Energy Policy and Conservation Act, and the enforcement of remedial orders. An explanation is given of the decisions made in Jack W.
