Outer Continental Shelf revenue sharing for coastal states

Congress has traditionally compensated states for the costs imposed on them by federal onshore land management programs either through revenue sharing or payments in lieu of taxes. However, the federal government has denied comparable compensation to coastal states for the costs they bear due to federal Outer Continental Shelf oil and gas development. This note argues that coastal states are both entitled to and greatly in need of comparable compensation. Part I reviews the history and policies of federal revenue sharing and payments in lieu of taxes. Part II traces Congress' efforts to afford some protection and compensation to coastal states affected by federal OCS activity. Part III examines legislative proposals considered by the 97th Congress that addressed the compensation issue.
