Sierra Club. v. Ruckelshaus

The background of the case of the Sierra Club vs. Ruckelshaus is discussed to illuminate the problems of that case and to suggest guidelines for applying EPA's venture into land use planning. The effect of the court's decision in that case is to establish a third ambient air quality standard, which has no basis in the language of the Clean Air Act; it ignores the act's carefully drawn statutory scheme and substitutes an additional substantive standard to the national primary and secondary ambient air standards established by the epa administrator. Results of the decision include: the public could be required to pay increased costs for energy resulting from abatement measures; nondegradation standards might result in the unavailability of US coal reserves to meet energy problems; and the nation's electric power reserves could be critically deficient in seven of the nine electric liability areas.
