Federal environmental litigation in 1976: Kleppe vs. Sierra Club

NEPA 69 has served, since its adoption in January 1970, to infuse consideration of environmental factors into federal agency decision-making and has provided environmental groups with a legal handle for forcing unwilling agencies to prepare adequate environmental impact statements before proceedings with actions that could have a significant effect on the environment. However, in the court decision concerning Kleppe vs. Sierra Club, USDI was exempted from having to prepare a regional environmental impact statement prior to leasing and developing coal reserves on federal lands in the northern Great Plains region. This decision may substantially affect the future direction of NEPA 69 litigation, especially suits to require comprehensive impact studies for interrelated federal projects. 234 references.
