Federal liability for spills of oil and hazardous substances under the Clean Water Act

A chronology of debates and litigation traces Section 311 of the Federal Water Pollution Control Act of 1970, the Amendments of 1972, and the final regulations of 1978. Two issues delaying implementation have been how to determine liability and how to apply section 311 to facilities regulated by the National Pollutant Discharge Elimination System (NPDES) permit program. The final regulations replace the term harmful quantity with reportable quantity, set forth three NPDES exclusions, and relieves the Environmental Protection Agency from determining the extent of actual harm. Offshore facilities must now report discharges which may not harm the environment and this could increase enforcement costs. Appropriate criteria for identifying potential hzards among reportable quantities should be developed. (DCK)
