A review of the oil and gas shelter portion of the IRS Examination Tax Shelter Handbook provides the framework for an analysis of the basic structure and features of an oil and gas tax shelter program. The handbook indicates that tax abuses are more likely to occur during the initial or early years of the partnership and directs the guidelines in the direction of such returns. The investor is advised that the IRS will be conducting more comprehensive tax examinations of oil and gas shelters in the future and will take a firmer position for potential disallowance of deductions.
