It has been determined that many oil shale mining claims located after the General Mining Act of May 10, 1872, and before the Mineral Leasing Act of February 25, 1920 have not as yet been patented or developed. Since both Acts were intended to accomplish the development of the mineral resources and the continued existence of these oil shale claims restricts the land from the development of other minerals which may exist on the claimed lands, this bill directs the Secretary of the Interior to notify holders of such claims of the requirements of this Act. Within 60 days after being notified, a holder of a valid oil shale mining claim for which a patent application was not filed prior to August 1, 1991, shall elect to proceed to limited patent or maintain the unpatented claim as provided for in subsections of the Act. Failure to file an election with the Secretary shall constitute an abandonment of the claim by operation of law.
