Status of LLRW disposal in the Southeast Compact Region

In 1983, eight states - Alabama, Florida, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, and Virginia - became members of the Southeast Compact through enactment of the Southeast Compact Law. The Southeast was one of the three regions which began with an existing regional disposal facility. That facility, located in Barnwell, South Carolina, had been operating under private management since 1971. It was expected that the facility in South Carolina would serve as the first regional facility and would close no later than December 31, 1991, when a second regional facility would be sited and operational. In September of 1986, the Southeast Compact Commission chose North Carolina as the second host state to develop the next disposal facility for the southeast region. In accordance with the original compact negotiations, the details of the actual siting, construction and operation of the facility were left to the State of North Carolina. The Southeast Compact now exists in a time of change and uncertainty and it is difficult to assess where the region is going in the future. North Carolina is still the designated host state and the Commission still expects North Carolina to fulfill its legal obligation to open a disposal facility. The region cannot count on Barnwell to be available tomorrow, next week or ten years from now and Envirocare cannot handle all of the waste streams from the Southeast and may never be able to do so. A regional disposal facility is still needed in the Southeast.
