Section 404 of the Clean Water Act (CWA) establishes a comprehensive regulatory program administered by the Army Corps of Engineers and US EPA for the `discharge of dredged or fill material` into `waters of the United States`. The term wetlands is never defined and appears only three times in the statute. However, it`s reach is expansive. Regulations and the courts have defined the waters of the United States phrase to include certain wetlands. Developers, farmers and local governments have found something lacking in section 404 of the Clean Water Act and continue to seek reform that would more closely benefit their interests.
