Toward a rational jurisdiction in the United States electric industry

Under current Federal law contained in the Federal Power Act (FPA), the Federal Energy Regulatory Commission (FERC) has jurisdiction to regulate the rates, terms, and conditions for transmission of electric power in interstate commerce. However, unlike its jurisdiction over interstate pipelines under the Natural Gas Act, the FERC has no jurisdiction to certificate the construction of interstate electric transmission facilities. As a result, such jurisdiction resides in state regulatory commissions, siting boards, environmental agencies, and even local zoning agencies. This means that a utility or a group of utilities wishing to build transmission facilities for interstate power transfers must obtain authority from agencies with jurisdiction where the facilities will be located. These approvals are in addition to the approval that the owner of the planned facility must obtain from the FERC and the state commissions for transmission rates and bundled retail rates to recover its prudent investments in transmission facilities.
