Comments of the FERC`s open access nondicriminatory transmission and stranded costs NOPR
The CPUC Staff generally supports the FERC`s effort to encourage greater competition in electric energy wholesale markets. Requiring utilities which own or control transmission facilities used in interstate commerce to provide transmission service pursuant to nondiscriminatory open access tariffs appears to be an effective way to accomplish this goal. Further, the CPUC Staff agrees with the FERC that the complex issue of stranded costs which might be created by increased electric industry competition must be addressed at the same time transmission grids are opened to competitive use. However, the CPUC Staff is extremely concerned that the FERC`s proposed rules will improperly usurp state jurisdictional authority over retail transactions and the transmission facilities used therein. Specifically, the CPUC Staff concurs with NARUC that the FERC is incorrect as a matter of law when it asserts that the Federal Power Act (FPA) provides for federal jurisdiction over unbundled transmission services to retail customers.
