Operating a federal facility to avoid environmental law liabilities

The responsibility to comply with environmental laws has become accepted in the US and the cost of compliance has become a routine cost of doing business, generally passed on to customers. Companies with the US government as a customer may find their ability to comply with environmental standards curtailed by specifications and other restrictions, and may find that shifting costs to the US is procedurally difficult. Procurting agencies have finally been forced to address the environmental responsibility in government procurement obligations and the location of costs of compliance. This article examines these issues in several areas including the following: shifting environmental liability to the US, and current agency practice regarding Environmental liabilities and compliance costs.
